III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion.of observations.made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. . <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. Bill Bear represented <br />the operator during the field inspection and records check. The mine site was covered in snow and it <br />was snowing during the inspection. <br />Main Mine Site <br />The longwall is presently in the WD-3 panel longwall mining inthe D -seam will be finished <br />sometime in March. The longwall equipment will be moved to the B-seam after that and B-seam <br />longwall mining will start around the first of April. The operator continues to construct the conveyor <br />system that will take mined coal from the B-seam portal bench up to the D-seam portal bench for <br />crushing, sizing and transfer down to the train loadout. A transfer tower is being constructed on the B- <br />seam portal bench. The support structures for the conveyor beltline are up and the conveyor belt <br />sections aze being installed. The cut slopes for the support structure foundations were stable. <br />The water tank bench was covered in several inches of snow. The bench bean was functional. The <br />access road up to this bench was snow covered but passable. Behind this bench, work continues on the <br />raised bore project for a ventilation shaft from the B-seam up to the D-seam. The bore has been raised <br />about 175 feet, or about half of the required height. The cut slope behind the pad appears to be stable. <br />There was very little coal stockpiled on the D-seam portal bench, due to the construction of the new <br />conveyor system. There were no problems with any of the facilities on the D-seam portal bench, <br />including the fuel barn. Culverts and ditches were under snow. There were no signs of slope instability <br />on and above the D-seam portal bench. However, the small slump in the haul road cut slope just before <br />the D-seam portal bench appears to have gotten a little bigger. This slump may need to be repasred if it <br />gets much bigger. The recent wet weather may have caused the slump to get bigger in size. <br />The paved main haul road was in good condition, although the recent construction projects have <br />damaged some of the asphalt surface. Road ditches and culverts were functional. The guazdrail was up. <br />No problems were observed at the main topsoil stockpile azea, which was completely covered in snow. <br />Collection and diversion ditches appeared to be functional and there were no signs of erosional or <br />slope instability, <br />There was only a small to moderate amount of stockpiled coal on the coal stockpile bench. There were <br />no signs of fugitive dust problems offsite. The berm on the outside edge of the bench was functional. <br />There is a slump developing in the cut slope above the wash plant. Except for the area of the slump, the <br />cut slope was covered with mulch blankets. If the slump gets to be lazge, iYmay compromise the road <br />above it. The operator is considering repair options. A synfuels plant on skids will be constructed next <br />to the wash plant. <br />
