~ay~8 <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />Post-Mine Channel PM-1 has been repaired and sediment was cast to the east of the channel. <br />The azea along the bank where the material was side cast has spazse vegetative cover and should <br />be graded and seeded. There aze rills and gullies forming in the PM-4 drainage azea above the <br />start of the PM-4 channel. This has been reported in previous DRMS inspections. These rills <br />and gullies should be hand repaired to the extent possible. Regrading of the azea may be utilized <br />to stabilize the rill and gully formation, and the azea should be seeded. Post-Mine Channel PM- <br />23 has experienced substantial erosion and needs to be repaired and maintained. A deep hole or <br />fissure has formed above the junction with PM-2. This erosion feature maybe associated with <br />the location of the former highwall and should be backfilled and stabilized. The design for PM- <br />23 is a vegetated, v-shaped channel. There is also some head cutting occurring in the main PM- <br />23 channel. Some reshaping of the channel is required and the site of the repair should be <br />seeded. Post-Mine Channel PM-2 is also a vegetated, v-shape channel design and is also <br />experiencing some minor erosion. This should be monitored and repaired if the channel deepens <br />significantly or bank erosion worsens. There is a substantial gully on the south side of Post-Mine <br />Channel PM-22 that needs hand repair work. A significant gully approximately 3 feet deep has <br />formed in Post-Mine Channel PM-10 just below the Solid Waste Disposal Area. There is <br />another significant gully on the west side of PM-10 that enters the main channel from the west <br />below Stock Pond T-4. An attempt has been made in the past to control the surface runoff and <br />sedimentation by using hay bails in the drainage, but this has been unsuccessful and the gully is <br />deepening. Please stabilize this gully by filling, regrading, and armoring the small drainage that <br />enters the main PM-10 channel. To the south of the gully along the hill slope above the main <br />PM-10 channel is a small hole forming with some exposed coal material probably associated <br />with the former highwall. This hole should be stabilized by backfilling and regrading the <br />immediate azea. Photographs of some of these locations aze shown in Photograph Numbers 18 <br />through 21. <br />Topsoil <br />The former locations of topsoil stockpiles were viewed. Topsoil stockpiles throughout the mine <br />site were fully used and the sites were regaded, with exception of Topsoil Piles A and P. <br />Topsoil stockpiles A and P remain for the shop/facilities area and the solid waste disposal site, <br />respectively. As previously discussed these areas were not included in the Phase I bond release. <br />Though not a Phase I reclamation success requirement, one reclaimed topsoil stockpile area and <br />associated access road was noted as an azea of concern with respect to revegetation. Former <br />Topsoil Stockpile X, located above Post-Mine Channel PM-18 and the access road to the <br />stockpile were recently regraded. The vegetation is sparse and these locations may need to be <br />reseeded. <br />
