III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />A complete inspection of the West Elk Mine was performed by <br />Christine Johnston of the Division. An oversight inspection was <br />conducted by Henry Austin of the Office of Surface Mining. The <br />inspectors were accompanied by Henry Barbe of Mountain Coal Company <br />and Kathy Welt also of MCC was available regarding permitting <br />issues and records review. The inspection covered 2 1/2 days, <br />beginning October 4, 1994 and ending on October 13, 1994. The <br />first day included inspection of the disturbed area. The second <br />day we inspected the water tank site and reviewed records. The <br />third day, Mr. Austin and I travelled to the Gunnison County <br />Courthouse to review the records available for the West Elk Mine. <br />AVAILABILITY OF RECORDS <br />Records were reviewed at the mine office. The Dry Meadow Reference <br />Area pictures were taken last week and were being developed. The <br />subsidence survey was being done at the time of the inspection. <br />Data for the hydrologic monitoring program has been collected <br />through October 4, 1994. The inspection report and compaction <br />testing of the refuse pile has been completed for third quarter. <br />This report should be forwarded to the Division as soon as <br />possible. For a complete list of records reviewed and comments, <br />please see the enclosed form. Records for the West Elk Mine were <br />also reviewed at the Gunnison County Courthouse. All permit <br />volumes are available, as well as revised pages for revisions <br />recently approved, and copies of revisions being reviewed. MCC <br />should attempt to visit the Courthouse at least once a quarter to <br />file the revised pages in the permit. <br />HYDROLOGIC BALANCE <br />Silt fence has been installed at the Lone Pine substation in <br />addition to the hay bales. MCC should install additional silt <br />fence or hay bales in this area to ensure that additional sediment <br />is not contributing to the undisturbed area. MB-4 should be <br />scheduled for cleaning in the near future. Another hay bale (to <br />add to three) should be installed in the ditch below the emergency <br />spillway of MB-2R (D3-4A). More riprap needs to be added to the <br />1 <br />
