• (Page 3) • <br />MINE ID #~OR PROSPECTING ID # M-B1-277 <br />INSPECTION DATE 03/01/99 INSPECTOR'S INITIALS ESC <br />The following problems (PB) and/or possible violations (PV) (and suggested corrective <br />actions) were identified during this inspection. The problems should be corrected by the <br />dates given, or they will become possible violations. The possible violations should be <br />corrected by the dates given to reduce their severity when considered by the Mined Land <br />Reclamation Board. The inspector noted on the previous page should be notified of all <br />corrective actions taken. <br />PROBLEMS/POSSIBLE VIOLATIONS <br />AND <br />CORRECTIVE ACTIONS <br />1. The operator failed to first obtain a reclamation permit prior <br />to engaging in a new operation in possible violation of 34-32.5- <br />109(1) of the Colorado Land Reclamation Act for the Extraction <br />of Construction Materials and permit M-81-277 or the operator <br />failed to protect areas outside of the affected land from slides <br />or damage during the mining and reclamation operations in <br />accordance with 34-32.5-116(4)(1) of the Colorado Land <br />Reclamation Act for the Extraction of Construction Materials and <br />Rule 3.1.5(3). <br />CORRECTIVE ACTION: <br />The operator will need to submit a conversion application to <br />convert M-81-277 from a 110 limited impact permit to a 112 <br />regular permit. Such application must include the total <br />affected area to incorporate all present and future disturbances <br />that have occurred and/or will occur as a result of this <br />operation and provide for reclamation of the additional <br />disturbance in accordance with the Act. <br />A complete 112 application must be submitted by April 28, 1999. <br />A permit must be obtained by August 6, 1999 if no objections are <br />received and by September 5, 1999 if objections are received. <br />Posting of an adequate bond must be submitted within 45 days of <br />the Division's approval of the conversion application. <br />DATE <br />PB or PV: <br />TOPIC (S):MP.OD <br />April 28,1999 <br />
