<br />MINE ID d OR PROSPECTING ID # M-81-277 <br />INSPECTION DATE 03/01/99 <br />(Page 2) <br />INSPECTOR'S INITIALS ESC <br />This was an inspection of the Beach Hill Quarries conducted by Erica Crosby and Carl Mount <br />of the Colorado Division of Minerals and Geology. Mike Loukonen representing Loukonen <br />Brothers Stone Inc. was present during the inspection. The purpose of the inspection was to <br />verify the location of permit boundary markers (noted in 11/11/98 inspection report) and <br />survey the affected area with the~Global Positioning System (GPs). <br />Eight (8) quarries make up the 9.9-acre permit area, and are identified from north to south <br />as Helsinki, Reino, Suomi, Kuopio, Hardrock, Dump, Isle, and Emil. Permit boundary locations <br />were marked, but the operator stated the markers indicate the permit boundary of the proposed <br />112 permit area. The Division used a Trimble GeoExplorer II GPS to determine the affected <br />boundary of the mining operation. The Division collected data by traversing the perimeter of <br />the affected area in each quarry. The data stored in the GPS unit was downloaded into the <br />Pathfinder Office software and was differentially corrected to reduce errors. The collected <br />data indicate that the Beach Hill Quarries are collectively 13.7 acres in size, roughly 3.84 <br />acres over the permitted area. The GeoExplorer II has a 2-5 meter level of accuracy. The <br />following is a list of the affected area of each quarry; <br />Helsinki- 1.9 acres <br />Reino/Suomi- 4.4 acres <br />Kuopio- 1.7 acres <br />Hardrock- 1.8 acres <br />Dump/Isle/Emil- 3.9 acres <br />Total Affected Area- 13.7 Acres <br />Based on data collected with the GPs, is apparent that mining operations have been conducted <br />outside of the approved affected area boundary. Therefore, there is a reason to believe that <br />a violation exists for mining outside the approved affected area or that the operator is <br />mining without a permit. <br />The possible violation and correction actions are noted as follows; <br />The operator failed to first obtain a reclamation permit prior to engaging in a new operation <br />in accordance with 34-32.5-109(1) of the Colorado Land Reclamation Act for the Extraction of <br />Construction Materials or the operator failed to protect areas outside of the affected land <br />from slides or damage during the mining and reclamation operations in accordance with 34- <br />32.5-116(4)(1) of the same Act. <br />The operator will need to submit a 112 conversion application. The application should update <br />M-81-277 so the total affected area and all present and future disturbances that have <br />occurred and/or will occur as a result of this operation will be included in the permit area. <br />A complete 112 application conversion application must be submitted by April 28, 1999.
