The problems should be corrected by the dates given, or they will become possible violations. The possible violations should be corrected by the dates given to reduce their severity when considered b)r the Mined Land Reclamation Board. The inspector noted on the previous page should be notified of all corrective actions taken. PROBLEMS/POSSIBLE VIOLATIONS AND CORRECTIVE ACTIONS CORRECTION DATE The operator was failing to protect the hydrologic )8/16/96 balance (34-32.5-116(h)) and was not following the PB or PV: PH approved mining plan, specifically exhibit G states TOPIC(S): H~ that a berm will be maintained along the west aide of MP, SC, SF, the pit area to prevent surface water from entering into the Yampa River and a drainage trench had been installed through the berm to allow surface water from the pit to enter the Yampa River. Corrective actions are to: 1) re-install the berm to prevent drainage from entering the Yampa River or; 2) Submit a technical revision to the permit to incorporate this change in the mining plan. This revision shall include all appropriate discharge permit e, amended maps clearly showing the drainage channel, and appropriate changes to "Exhibit G" describing how surface water will be handled ae mining progresses at this operation. If option f 1 ie followed, a photograph clearly showing that the berm has been re-installed shall be submitted prior the expiration of the corrective action date.
