<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Sanborn Creek Mine that began the afternoon of October 12 <br />and was finished the following day. Mark Milner accompanied me on the inspection. The weather <br />was warm and clear. Ground conditions were dry. The DMG just approved the bond yesterday so <br />construction has not yet started on the Elk Creek Mine surface facilities. OMI is hoping to begin <br />construction soon. The operator was producing coal from the Sanborn Creek mine during this <br />inspection and on Friday a unittrain was being loaded. <br />Records <br />Records were checked in the mine office on Thursday. A copy of the records checklist is attached. <br />The insurance certificate has expired, but OMI sent a copy of the renewed insurance certificate to the <br />DMG several weeks ago. Some of the language needed to be changed and OMI is waiting for the <br />corrected form from the insurance company. <br />Roads <br />Roads were in good condition and well maintained. <br />Hvdrolo,gic Balance , <br />Sediment Ponds A1, B, C, the East Yard pond, the Substation No. 3 pond, and the Hubbard Creek <br />ponds were inspected. None of them were discharging. Ponds B and C were cleaned recently. All <br />ponds were well maintained. <br />OMI continues to spray the longwall face for dust control. As a result, water and muck dripping off <br />the mine conveyor beltline continues to be an operational challenge. The largest volume of material <br />is deposited below the transfer points. Currently, most of the runoff flows into the East Yard Pond. <br />OMI is cleaning this pond on a regular basis to provide sufficient storage capacity for the inflow. <br />Waste removed from the pond is placed in the East Yard temporary waste pile to dry out prior to <br />being transported to the waste pile. The small area exemptions, south of the conveyor have been <br />cleaned, and OMI has a crew cleaning the areas below the beltline. OMI is managing the water, but <br />it is labor intensive. They are exploring other options. <br />Water was being pumped from the Sanborn Creek mine into the mine water settling pond and water <br />was discharging from the pond during the inspection. <br />Backfilling and Grading <br />All backfilling and grading has been completed for the drill holes in the C Gulch. The entire <br />disturbance has been regraded, mulched and seeded. <br />Explosives <br />OMI has published the blasting notice in preparation for site development activities in Elk Creek. <br />One individual requested apre-blast survey. <br />
