erosion. All piles had berms constructed around the base to <br />prevent loss. As mentioned above not all piles have been <br />addressed in regards to the runoff from precipitation. <br />BACKFILLING AND GRADING: The only backfilling and grading <br />completed at this time is at refuse disposal area #1. This <br />area is vegetated and no erosion was noted. Some of the lay- <br />down areas used during construction of the mine facilities <br />have been reclaimed. There was some doubt as to whether this <br />was final reclamation. These areas are vegetated primarily <br />with crested wheatgrass and would not meet the diversity <br />standard for a bond release. <br />COAL MINE WASTE: As mentioned above there were maintenance <br />problems with ditches around the refuse piles. There is also <br />a problem with the storage of wet refuse on top of piles under <br />construction. The placement of this material introduces a <br />substantial amount of water onto and into the pile. This has <br />the potential to make the long term stability of the pile <br />questionable. It has been suggested that the company use a <br />temporary storage area for the drying of the refuse. The <br />company has agreed to consider this option but made no <br />commitment since the permit allows the current practice. <br />The permit expires in July of 1999 and DMG can address the <br />storage issue during the permit renewal if the company does <br />not propose a solution for temporary storage. <br />DISTANCE PROHIBITIONS: There are no public buildings, <br />churches, cemeteries, dwellings or other structures within the <br />permit area not owned by the company. <br />SUBSIDENCE: No subsidence was observed in the field. <br />EXISTING ENFORCEMENT ACTIONS: None. <br />ENFORCEMENT ACTIONS FROM THIS INSPECTION: The following <br />Notices of Violation were issued during this inspection: <br />1. C-93-153 Failure to make annual submittal of pond <br />inspections to the DMG by a registered engineer. <br />2. C-93-154 Failure to construct and maintain diversions <br />according to the approved design. <br />3. C-93-155 Failure to pass runoff from a disturbed area <br />through a sediment pond or demonstrate that it meets <br />9 <br />
