' (Page '3) <br />MINE ID # OR PROSPECTING ID # M-90-057 <br />INSPECTION DATE 11/16/00 INSPECTOR'S INITIALS ESC <br />The tailings pond is approximately 1/3 acre in size. The small amount of material processed <br />last year was frozen and under snow cover. Trees from the pond embankment were removed last <br />year following the Divisions inspection. The operator will need to ensure that the pond <br />embankment is free of trees and shrubs as to not jeopardize the integrity of the dam. <br />Three waste rock piles were noted east of the mill structure. The operator will need to <br />revise the mill mine plan map in the form of a technical revision (no application fee <br />required) to depict the location of the waste rock piles and submit a proposed reclamation <br />plan. It should be noted that all piles must be located inside the permit area (6 .6 acres). <br />Please be aware that if this area exceeds the 8.5-acre permit area, a new permit application <br />will need to be filed (please note that an amendment to the permit is not allowed under a <br />Hard Rock/Metal Mine 110(2) permit). Attached is an application form for your use if filing <br />a new permit is needed. <br />The Division is reviewing the application to determine if the site meets the definition of <br />"Designated Mining Operations" as defined in Rule 1.1(14). Under the definition, it states <br />that metal mining operation, permitted under Section 34-32-110 which do not use or store <br />designated chemicals, shall be exempt from the requirements applicable to Designated Mining <br />Operations, unless they have a potential to produce acid mine drainage in quantities <br />sufficient to adversely affect any person, property or the environment. <br />Proper construction of the tailing pond is an important criteria to determine if there may <br />be adverse impact to any person, property or the environment. Condition #4 on the application <br />approval requires that the earth liner in the tailing impoundment be constructed with <br />material with permeabilities less than or equal to 2 feet per year. A minimum of 12 inches <br />of suitable material should be compacted to 95~ Proctor Density. Field run compaction data <br />should be submitted for each phase of the tailing disposal facility immediately after <br />construction. This information will assist in the Division's determination if the site meets <br />the definition of a "designated mining operation." The operator will be informed of the <br />Division's determination at a later date. <br />The following items will need to be addressed at the mill site; <br />3. The Division was unable to locate any permit boundary markers. Rule 3.1.12(2) requires <br />the boundaries of the affected area to be marked by monuments or other boundary markers. <br />The operator will need to mark the affected area and submit proof in the form of <br />photographs by January 19, 2000. <br />4. The operator will need to identify areas where temporary ore will be stored inside the <br />permit area, and how the area will be lined to prevent the contamination of surface water <br />and groundwater. Location and description of the temporary ore stockpiles and a <br />reclamation plan must be submitted to the Division in the form of a Technical Revision by <br />January 19, 2000. <br />Miscellaneous Issues <br />5. On June 5, 1990, the Division approved the Hopemore & Leadville Mine with four (4) <br />conditions to the permit. A copy of the conditions is enclosed for your review. The <br />Division has not received any of the information required by the conditions. Please <br />inform the Division the status of each condition noted on the approval letter by January <br />19, 2000. <br />
