III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />Every informed us that they are planning to install a french drain <br />in the area of a small slump which occurred on the cutslope early <br />in the spring. At the time of the inspection the cutslope was <br />being hydroseeded. As regrading of the bench continues, the <br />ditches should be improved and maintained at the designed <br />configuration. <br />MCC is continuing to look into options to access MB-5, as the usual <br />route is unsafe. Two options being considered is a bridge to span <br />the North Fork from Highway 133 to the permit area in the MB-5 <br />area, or to blast the rock overhang, which is the source of the <br />safety concerns. The preferred option is the bridge due to cost. <br />Slides and Damacte <br />MCC has had a number of problems concerning stability this spring. <br />One of the major problems is portal ,~1. MCC is in danger of losing <br />this portal as it is moving. Since the Division's last inspection <br />MCC experienced a mud flow which came from the roof and partially <br />blocked the portal. There is a displacement of about i-2' between <br />the portal bench and the floor of the portal tunnel. MCC is <br />working on a solution to repair the portal, or if there will be no <br />effect on portal i~2, to lose the portal. They have excavated the <br />area above the portals, which has been previously disturbed, to <br />repair cracks and check the functionality of the french drains. <br />They are planning to excavate deep trenches above the portals that <br />will be lined with gravel to collect surface water and route it to <br />the manhole, which then goes to MB-1. They are also planning on <br />doing load tests on the bolts which anchors the portal. <br />The culverts that had been noted as being pulled apart in the <br />Division's previous inspection to the east of the portals have been <br />repaired. <br />The buttress for the haul/access road was inspected. Mr. Every <br />informed us that measurements are being taken on a regular basis <br />and the buttress is working well. <br />Excess Sooil and Development Waste <br />MCC is planning to apply subsoil and topsoil the east and west side <br />of the refuse pile this year. The Division recommends that MCC <br />follow through with this plan. MCC should ensure that ditch D2R-4 <br />has been installed as designed. This ditch has been labeled as <br />future but now appears to be required as the contours of the pile <br />now drain back to the road. Failure to install the ditch as <br />required will result in the issuance of a notice of violation. <br />
