III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />A partial inspection of the West Elk Mine was conducted by <br />Christine Johnston. The main focus of this inspection was to give <br />the Division Director, Michael Lonq, an opportunity to inspect the <br />Lone Pine Gulch development waste pile, which is the focus of an <br />NOV written in May 1995 by Tony Waldron. Mr. Long and Mr. Waldron <br />were present during the portion of the inspection which included <br />the Lone Pine area. Representatives from MCC during this portion <br />of the inspection included Phil Schmidt, Kathy Welt, Henry Barbe, <br />John Poulos, and Norm Every. The inspection also concentrated on <br />stability problems that have occurred in the last few months and <br />the proposed upper refuse disposal pile. Henry Barbe and Norm <br />Every of MCC accompanied Christine Johnston and Jim Pendleton of <br />the Division for this portion of the inspection. Mr. Pendleton and <br />Ms. Johnston were also present for the inspection of the Lone Pine <br />facilities. The weather during the inspection was clear, warm and <br />sunny. <br />Signs and Markers <br />MCC should ensure that all perimeter markers clearly marking the <br />perimeter of all areas affected by surface operations for the Lone <br />Pine Gulch facilities are posted by the Division's next inspection. <br />This includes the substation, staging area, fan pad, topsoil pile, <br />and development waste pile. MCC should also ensure perimeter <br />markers have been posted at the main facilities. Failure to <br />properly mark the perimeter will result in a notice of violation. <br />Roads <br />Enkamat has been placed at the outlet of the culverts along the <br />north facing slope of the Lone Pine Gulch road to protect the <br />outlet from excessive erosion and for sediment control. The <br />Enkamat had been recently installed and it did not appear that a <br />rain event had occurred, so its effectiveness is not known at this <br />time. Installation appears appropriate. <br />Hvdrologic Balance <br />For comments on hydrologic structures, please see Support <br />Facilities in regards to the material storage bench and Excess <br />Spoil & Development Waste in regards to the Lone Pine development <br />waste pile and the lower refuse pile. <br />Suooort Facilities <br />Final grading work has been continuing on the material storage <br />bench as the weather has been drier. The final grade of the access <br />road from the haul/access road is still being constructed. Mr. <br />
