111. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion.of observations.made <br />during the inspection: Comments also describe3 any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. . <br />This inspection consisted of two parts. The first part was a partial inspection of the Bowie No. 2 mine " <br />site on July 20, 2004 and conducted by Joe Dudash and Sandy Brown of the Colorado DMG. Bill Beaz <br />represented the operator. The second part was an inspection of several reclaimed exploration drill sites <br />on July 21 and 22, 2004 for the purpose of detemuning the possible release of the reclarriation bond for <br />those sites. Joe Dudash and Sandy Brown represented the DMG on the July 21 inspection while Joe <br />Dudash represented the DMG during the July 22 inspection. Greg Hunt represented the operator on <br />both drill site inspection dates. <br />Insuection of the Bowie No. 2 Mine <br />Facilities <br />The operator is currently longwall mining in the southern portion of the second longwall panel in the <br />western district (VJD-2). <br />The rock catchment berm appeazed to be functional. Mining has progressed to the second longwall <br />panel so most of the danger from rockfalls due to mining in the first panel azea may have already <br />passed. Portions of the black fabric of the rock catchment berm aze still exposed to sunlight, which can <br />resulYin material degradation and reduced effectiveness of the berm itself. The operator has ordered a <br />coating for the fabric which, when applied, should protect the fabric. <br />Operations on the D-seam portal bench appeazed to be normal. There was a lazge amount of stockpiled <br />coal on the bench. No problems with fuel leaks at the fuel barn were observed. Below the bench, the <br />operator constructed a temporary road for access to a future geotechnical drilling site, in support of the <br />eventual construcfion of the B-seam upland conveyor system. <br />The B-seam portal continues to be developed. Development coal is being brought out of the mine and <br />trucked off of the B-seam portal bench. A temporary conveyor loader is being used to load the haul <br />trucks. One small spring has developed in the highwall of the B-seam portal bench. The water is being <br />piped into an established drainage channel. No geotechnical stability problems have surfaced with the <br />construction of the B-seam portal bench. <br />The coal prepazatipn (wash) plant is nearing full production status. The building's siding and roof still <br />need to be installed, however. <br />There was a lazge amount of stockpiled coal at the lower coal stockpile bench. There were no problems <br />noted with offsite fugitive dust. <br />
