III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology (DMG). The weather was warm and ground conditions were dry. <br />Areas were easily accessible by foot and vehicle. This mine has closed and reclamation of <br />most areas is complete. George Patterson of Energy Fuels Coal Inc. was present during the <br />inspection of the mine records at the EFCI office in Florence. <br />Availability of Records <br />The mine records are kept at the EFCI office in Florence. All records. were found current and <br />in compliance. Details of the records check can be found on page 2a of this report. <br />Roads <br />The access road traversing the main reclaimed area was dry. Water bars divert runoff from <br />the road surface at numerous locations into the access road drainage ditch that ultimately <br />diverts flows into pond 5. This road will require periodic maintenance to allow access to the <br />refuse disposal area (RDA) and the Newlin Creek topsoil pile SAE. The road around the <br />RDA was driven and found in good condition. The road to the NCTP was rough and <br />moderate sized rocks were found along the roadway. Runoff and drainage along this road is <br />controlled using check dams periodically in the ditch. Road culverts were clear and <br />functional. The light use road to the South Fan site was rough in some places due to travel <br />during muddy conditions this spring. Periodic maintenance should be conducted as <br />necessary. <br />Hydrologic Balance <br />Pond 5 was dry and the embankment appeared in good condition. Rock has been placed in <br />the access road ditch prior to entering the pond inlet to help control downcutting noted in last <br />month's inspection. Magpie Creek diversion was not flowing and appeared in good <br />condition. Pond 4 was holding only a muddy pool of water. The embankment and three <br />spillways appeared normal and in functional condition. All SAE areas were unremarkable <br />and no problems were noted. <br />Processing Waste <br />The RDA was traversed on foot. Vegetation is good to excellent in most areas of <br />reclamation more than one year old. Transplanting of shrubs in the approved locations has <br />been completed. Diversion ditches appeared normal and functional. Evidence of heavy <br />runoff was not observed. <br />3 <br />
