IV. ENFORCEMENT ACTIONS <br />The following identifies enforcement actions taken during this inspection, the required abatement <br />and date of abatement for the violation, previous violations still requiring abatement and the <br />termination of violations cited during previous inspections. <br />Notice of Violation C-96-013 has been issued as a result of the observations documented in <br />Section III of this report, regarding the management of subsoil resources at the Lower Refuse <br />Pile. Detailed observations leading to the issuance of this violation were made on June 12, <br />1996, and June 13, 1996. Specifically, Notice of Violation C-96-013 is issued for: the <br />operator's failure to separately remove and segregate subsoil material prior to burial with <br />refuse material at the northwest corner of the Lower Refuse Pile; failure to remove subsoil <br />resources so as to ensure the physical and chemical characteristics of the subsoil as evidenced <br />by the use of machinery on areas of the pile sufficiently wet so as to result in machinery <br />becoming stuck in the sot! material, mixing the subsoil with refuse; and failure to obtain <br />approval prior to a subsoil storage location. <br />The subsoil materials buried and mixed during the construction activities were specifically <br />dedicated for use during future reclamation of the refuse pile. All subsoil located on the <br />north and east pile slopes and benches was to be salvaged for use during future reclamation <br />and so as to avoid loss of the dedicated subsoil resources. <br />On June 13, 1996, and immediately upon notification by Mr. Berry that a violation had <br />occurred, Mr. Barbe and Mr. Avery directed the equipment operator to initiate an effort to <br />salvage, to the extent possible, buried subsoil material at the northwest corner of the pile. <br />This effort did result in the recovery of some of the buried subsoil, and in this specific area, <br />abatement of the violation had occurred to the extent possible. <br />Recovery of the subsoil mixed with refuse at the location where the dozer had become stuck <br />(pile east flank) was probably not feasible due to the mixing of materials during wet <br />conditions. Abatement at this location may not be feasible. <br />The unpermitted subsoil pile location remained unabated at the close of the inspection.
