III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />At this point, it appeared that salvaging operations had recovered <br />as much of the buried soil material as possible. <br />Photos were taken of the unapproved subsoil laydown area on the top <br />of the pile, the refuse ramp area, and the east flank area. <br />Hydrologic Balance <br />It was noted that the underdrain at the toe of the refuse pile, on <br />the west side was seeping. It was also seeping at the base of the <br />pile on the east side. <br />MB-2R spillway was discharging at the time of inspection. The <br />discharge was brownish colored, foamy, and turbid. A sample for <br />TSS was collected by MCC during the inspection. Please provide the <br />results of this sample collected on the morning of June 13, 1995. <br />It was noted that MCC did a good job of fixing the straw bales <br />below the bermed area of the train loadout conveyor take up (river <br />tower). Please develop a plan to more effectively control coal <br />blow down in this area. Also the berm surrounding the river tower <br />needs to be built up on the north side. <br />Support Facilities <br />Please continue to ensure coal remains within the Pond 4 drainage <br />system. <br />The road up to Lone Pine fan was in good condition. All ditches <br />and culverts were in good condition and functioning properly. <br />Revegetation <br />It was noted that a minor amount of thistle was present on the Lone <br />Pine waste development pile. Please continue to monitor and <br />control this situation. <br />
