III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />The culvert at Sylvester Fan discharge point is leaking. To ensure <br />continued compliance, please repair the damaged pipe. <br />Support Facilities <br />Please clean the trash that has collected on the slope below the <br />bench west of the trash compaction area. <br />Please be aware of and try to minimize drips and spills of <br />hydraulic fluid and oil from vehicles in the following locations: <br />parking area east of surface maintenance shop, parking area east of <br />warehouse, and the general vicinity south of the Underground Shop. <br />Please pay particular attention and reduce spills of fuel from the <br />dispenser at the fuel storage/refueling area. <br />Topsoil <br />To ensure continued compliance, please consider options for <br />maintaining coal pile from running over onto topsoil/vegetative <br />cover on the north, west, and south sides of coal pile. <br />Specific topsoil problems are noted below. <br />Excess Sooil & Development Waste <br />During the early afternoon of June 12, 1996, the inspection <br />proceeded to the Lower Refuse Pile location. The DMG inspectors <br />Berry and Boulay viewed the refuse pile from the top of the pile. <br />It was observed that the topsoil and subsoil salvage operations <br />approved and required with Technical Revision No. 78 were in <br />progress. Topsoil and subsoil materials previously placed on the <br />north and east pile flanks and benches were being removed, and <br />transported to the two approved storage locations on top of the <br />refuse pile. At that time, topsoil and subsoil were being placed <br />only in the two approved locations. <br />During the inspection, MCC representative Johnston told Berry that <br />the operator was encountering more topsoil and subsoil on the north <br />area than was anticipated. Ms. Johnston asked if approval could be <br />granted to initiate a third soil material storage pile on top of <br />the pile, along the northeast area of the pile top. Berry stated <br />that approval would not be given at that time, and that the issue <br />would require additional discussion to assess other options. Berry <br />and Johnston agreed that additional discussions would occur the <br />
