III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by David Berry and Mike <br />Boulay both of the DMG. Christine Johnston, Henry Barbe, and Norm <br />Avery of Mountain Coal Company (MCC) accompanied the DMG during all <br />or part of the inspection. The inspection was completed over the <br />course of two days. The weather was dry and hot on both days. <br />Day One Inspection (6/12/96): <br />HVdrOlOg1C Bd1aRCe <br />Maintain the culvert and continue to maintain adequate sediment <br />control and drainage at the Material Storage Bench where the access <br />road enters the bench on the west side to ensure continued <br />compliance. <br />Clean out and maintain the ditches and culverts at the Portal Bench <br />above the Portal Bench storage area to ensure continued compliance. <br />Devise a barrier where underground mine water discharges to surface <br />at the upper bench below the conveyor belt. Devise a strategy to <br />keep the discharge water in the ditch and not onto the bench <br />material. <br />Maintain straw bales or other measures above the inlet of culvert <br />that receives water from the MB-1 spillway to ensure continued <br />compliance. <br />Emergency spillway for MB-1 and FW-1 has some coaly material on the <br />upper edge of the spillway. MCC has agreed to clean this out by <br />installing a cut-off trench with a silt fence installed behind the <br />trench as a catchment. A water truck will be used to wash the coal <br />material out of the spillway where it will be collected and <br />removed. <br />Please continue to take measures to keep coal material out of ditch <br />that drains north from the Crusher Facility. <br />It was noted that mine inflow water was being discharged to FW-1. <br />The water was running fairly clear. <br />Please cleanout the culvert under the roadway located south of bays <br />5 & 6 of the "Underground Shop". <br />Please repair the minor damage to the culvert at the entrance to <br />Sylvester Gulch Access Road. <br />
