III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />The contractor is nearly done with the vent shaft construction. The next step is to pour the concrete stem <br />walls and, then, assemble the vent fan. <br />A 5~ gallon drum of, what appears to be, grease is sitting next to pond D. This barrel should be moved to <br />an appropriate storage place. <br />Veaeta[ion <br />Several of the slopes at the mine site need reseeding. Either the seed did not take or mainly clover is <br />growing on the slope. These slopes include the coverfill stockpile, the gob pile topsoil stockpile, the pond <br />C embankment, some of the cut and fill slopes for the paved main haul road and the highwall slopes <br />above the portal bench. <br />There are several areas where noxious weeds have become established and these areas need to be sprayed <br />within the next week or two before the seeds are spread. During the inspection, whitetop was observed at <br />three locations along the gob pile haul road, two areas on the south side of the road and one area north of <br />the road. Another area of whitetop was observed on the north side of pond C, just west of [he old concrete <br />building structure. Also, whitetop was seen on the larger of the two topsoil stockpilesjust north and . <br />adjacent to pond B. <br />Gob Pile <br />The operator has placed piles of different material on the top of the gob pile. Several piles of <br />uncompacted coal refuse are on the pile, waiting for shipment to the Cameo Mine near Grand Junction. <br />Another few piles of subsoil are also on the refuse pile. The subsoil came from the excavation of the hole <br />on the portal bench for the new sewage treatment system holding tanks. The operator did not have any <br />room on the portal bench for the piles. The subsoil will be moved back to the portal bench when the <br />sewage treatment system is backfilled. The operator is separating rocks from the subsoil for a source of <br />riprap. <br />The operator is also storing the muck from the construction of the vent shaft on the top of the gob pike. <br />The Division has contacted the professional engineer who is in charge of certifying the construction of the <br />gob pile to make sure that he is aware that this muck is at the gob pile. <br />c:\ms97\bow ie2\i nsp0599 <br />
