III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash and Larry Routten of the Colorado Division of <br />Minerals and Geology. Gary Harding represented the operator. The weather was clear and.dry during [he <br />inspection. However, the operator stated that there had been a considerable amount of rain in the past few <br />days. <br />Roads <br />The paved main haul road was in excellent condition, as was the graveled haul road leading to the refuse <br />disposal area. <br />Hvdroloev <br />The water levels in ponds B and C were just above the primary spillways. There were no discharges from <br />ponds B and C since the gated valves were closed. Pond D was dry. Pond spillways were functional and <br />the embankments appeared to be geotechnically stable. The sediment deltas forming at the inlets to ponds <br />B and C appear to be coming close to the inlets of the primary discharge tubes, especially at pond B. The <br />operator needs to note the sediment level at and near the ponds' primary inlets when the water level is low <br />in order to make sure that the ponds can still function. <br />The two culverts leading into pond D and the one culvert downstream from pond C were clear..The hvo <br />culverts under the portal bench were also cleaz. <br />The clean water diversion ditch on the east side of the coverfill stockpile was recut. New hay bales need <br />to be placed at two locations in the ditchjust south of the coverfill stockpile. The upland diversion ditch at <br />the gob pile was also recut. <br />A high berm has been constructed on the edge of the portal bench <br />Topsoil <br />There was no gullying on the gob pile topsoil pile and on the coverfill topsoil pile. Topsoil signs were up. <br />The ditch on the south end of the coverfill topsoil stockpile, between the topsoil pile and the straw bales, <br />needs to be cleaned out. <br />Facilities <br />The new bathhouse and office building is under construction at [he portal bench. The sewage treatment <br />system for [he bathhouse and office also is being constructed. <br />
