III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />Train Loadout <br />The sediment control system for the loadout bench was in place. The collection and diversion ditches were <br />functional and culverts were clear. Ircigation water was flowing through the central diversion channel and <br />culverts. The sediment pond was dry. The gated primary was closed. The upland diversion ditch and culverts for <br />the pond were functional. No irrigation water was flowing in the underlying Farmer's Ditch. <br />The topsoil stockpile was well vegetated and the topsoil sign was in place. There was no activity at the train <br />loadout, with only one Union Pacific work railcar on site. No problems were noted with the facilities. The new <br />mine [D signs were up at the three entrances. Surface disturbance markers were up. <br />Hiehway Coal Stockpile <br />The sediment pond at this site was dry. Straw bales were in place around the inlet of the west side culvert. The <br />operator has received approval to remove the straw bales along the railroad tracks, since the bales were needed <br />for sediment control when railcars were being loaded. This site has been partially reclaimed so loading <br />operations are no longer performed. Surface disturbance markers were present around the disturbed area. The <br />road into the site was in good condition. <br />West Mine <br />The sediment control system was in place at the West Mine. Both sediment ponds in series were dry. The gated <br />primary of the upper pond was open while that of the lower pond was closed, as designed. Pond embankments <br />were stable and spillways were functional. The riprap in both of the emergency spillways was intact. Straw bales <br />and silt fence were in place. <br />There was a good vegetative cover on the backfilled and graded portal bench area. There were no indications of <br />erosional gullying or slope instability at the site. Surface disturbance markers were up around the site. Two new <br />mine ID signs have been put up, one at the entrance to the fan site and one at the reclaimed main entrance road. <br />[t appears that the posts that mark the boundary between the upper backfilled and topsoiled area from the lower <br />area may need to be moved to reflect the final configuration. <br />The operator has placed and graded topsoil on the backfilled area of the West Mine fan site. The silt fence at this <br />site needs to be extended northward to include the former topsoil stockpile azea. <br />Records <br />The records were in compliance, as documented in the attached records checklist <br />c:/word/bowie 1 /insp 1005 <br />2 <br />
