III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. No one represented the <br />operator during the field inspection. Basil Bear was present for the records check. <br />East Mine <br />The entrance gate was locked. The new mine [D sign was on the gate and it contained the correct information. <br />The paved haul road leading to the crushedscreener bench and the graveled access road to the upper bench were <br />in good condition. The Tight use roads leading to the bin wall ponds and to the West Ridge waste pile were in <br />good condition as well. Road ditches had sufficient capacity. <br />The operator has dismantled one of the water tanks on the upper bench and hauled away the material. The <br />concrete wall for one ofthe fan shaft sites also has been knocked down, with some oftite debris still on site. <br />Now there is only one water tank remaining on that bench. There has not been any other reclamation activity at <br />the east mine. <br />The sediment control system at the East Mine was in place. Collection and diversion ditches, berms, culverts <br />and straw bales were operational. <br />Of the four bin wall ponds, only the second from the top had any standing water in it, and that elevation was <br />within 1 %z feet from discharge. There were no leaks in this pond's bin wall. The gate on the lowest pond, the <br />NPDES sampling point, was closed. There was only a little standing water in the West Ridge waste pile pond. <br />All of the pond embankments and bin walls were stable and the spillways were operational. <br />There have not been any recent additions to the West Ridge waste pile. The waste pile was well vegetated. The <br />outslopes and terraces appeared to be stable. The collection and diversion ditches and culverts associated with <br />the waste pile had sufficient capacity. There were no slope stability or erosional stability problems at the old <br />coal waste disposal site. This site was well vegetated. <br />The mine benches and their cut and fill slopes appeared to be stable with no evidence of slumping or gullying. <br />Surface disturbance markers were up azound the disturbed area. Topsoil stockpiles had fair to good vegetative <br />cover and signs were up. <br />Run-Of--Mine (ROM) Stockpile <br />The top of the OM pile was relatively dry with positive drainage. The collection ditches were well vegetated and <br />had sufficient capacity. The culverts were clear of debris. There was no standing water in the sediment pond. <br />The graveled haul road was in good condition. The new mine ID sign and the surface disturbance markers were <br />up. The topsoil stockpile was in good condition. <br />Well Field <br />A new mine ID sign has been put up at the entrance to this site. Surface disturbance markers were up around the <br />site. The topsoil stockpile had good vegetative cover. The topsoil sign was up. <br />
