III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments Jnclude discussion.of observatlons made <br />daring the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. . <br />This was a complete inspection by Joe Dudash of the Colorado DMG. No one represented the operator <br />during the field portion of the inspection. Basil Bear represented the operator during the records check. <br />Unit Train Loadout <br />A string of empty railcars was sitting at the loadout, although no loading operations were in progress. <br />There were no coal haul trucks on site. All three front gates were open and there were no signs of coal <br />dust on the main highway. <br />The sediment control system was in place. The collection ditch on the west end of the site had <br />sufficient capacity. The clean water diversion ditches, culverts, straw bales and berms in the center of <br />the site were functional. There was no water in the sediment pond. The upland diversion ditch and <br />culverts above the pond were functional as well. <br />There were no teaks at the fuel facility. The berm around the facility was up. There was no activity on <br />site, although the operator was storing drill pipe near the silos. Mine ID signs were up. <br />Hiehwav Coal Stockpile <br />There was no activity at this site, which has undergone interim reclamation. The empty rail cars were <br />on site. The road down to the site was in good condition. The mine ID sign was present at the top of <br />the road. The sediment pond was dry. The discharge pipe was in place- On the weft side of the site, an <br />additional straw bale should be placed at the inlet of the culvert under the tracks for better sediment <br />control. The vegetative cover is beginning to turn brown. <br />Run-of--Mine (ROM) Stockpile , <br />The mine ID sign was up at the site entrance. Surface disturbance markers were up around the site as <br />-well. The graveled haul 'road was in very good condition. There was only a very small pool of standing <br />water on top of.the pile: The rest of the pile was dry. The topsoil stockpile sign needs to be put back up <br />on its post. The culverts at the site were clear and the collection ditches had sufficient capacity. The <br />sediment pond was dry and the gated valve was closed. <br />East Mine <br />The gate to the East Mine was closed and locked. The paved haul road, access road and light use roads <br />were all in good condition and were passable. However, there are rills forming in the access road just <br />below the transfer tower bench. The road ditch in that area needs to be deepened. There have not been <br />any new reclamation activities at the site. <br />
