A site inspection was made of the Turnpike Mining Resource in response to a citizen complaint of a possible illegal <br />mining operation at the location of the Turnpike Mining Resource. The citizen complaint was received from David <br />Smolijan, an adjacent landowner. (See attached complaint fetter). <br />2. The Smolijan residence at 556 Weld County Road 16 ~/z was visited. This inspector spoke with Mrs. Smolijan who <br />indicated that she had not received any proper notification for a proposed mining operation. This inspector confirmed <br />that the site in question is the Turnpike Mining Resource, Permit M-2004-009. Further review of the permit file indicates <br />that a mining and reclamation permit was issued to Asphalt Specialties Company, Inc. on August 4, 2004 by the Division <br />of Minerals & Geology. A permit was issued for a total of 275.4 acres. The mine plan specifies de-watering and dry <br />mining methods. The site will be reclaimed to agricultural use. Disturbed areas will be backfilled & graded, topsoiled, and <br />revegetated with a grass mix. The operator has provided a financial warranty of $249,250 which is adequate to complete <br />reclamation of the planned disturbance. <br />3. A briefinspedion of the Turnpike Mining Resource indicated that an entrance sign has been posted in accordance with <br />Rule 3.1.12, along State Highway 52. The plant forman present on site indicated that the plant site for the planned <br />mining operation is in the initial stages of construction. Topsoil from the plant site area has been stripped and salvaged. <br />The forman indicated that a mining permit had been issued for the project and that the operator had gone through the <br />Division's permitting process earlier this year (2004). <br />4. Review of the permit file indicates that Mr. Smolijan was sent a notice of the proposed operation via certified mail <br />return receipt by the applicant, but that the notice was unclaimed. See attached proof of notice. Based on this <br />information, the Division concludes that Asphalt Paving Company, Inc. had sent proper notice to the Smolijan's. However, <br />if any further information becomes available to prove otherwise, the Division is prepared to review such information. At <br />this time, it appears that the operator has completed the Division's permitting process in accordance with the Mineral <br />Rules & Regulations of the Colorado Mined Land Reclamation Board for the Extraction of Construction Materials. <br />5. The Division will be happy to provide any further details on the permitted mining operation to the Smolijan's ,upon <br />request.
