Pape <br />• - .. , <br />Page 84 ~=, <br />Construaron Materials Rule 4 `>.;: ~ <br />4.163 Specific Provisions -Regular 112 Operations <br />The Operator/Permittee will be notified of the 06ce decision within sixty <br />(60) days. <br />4.16.4 Time Limit for Appeals to Decision <br />Within sixty (60) days of the date of the inspection, the Office shall notify <br />the Operator, and any person who provided written comments to the OH'ice <br />pursuant to Section 4.17, of its decision to approve or deny the request for <br />reclamation responsrbility release. <br />4.17 PQBLIC CONIII~NT AND NOTICE -RELEASE OF FINANCIAL <br />WARRANTY <br />rte (1) Any aggrieved Person has the right m file a written objection <br />to and any person may submit written comments on the request <br />for reclamation responsibility release so long as such comments are <br />sabmimed to the 06ce within ten (10) days of the O~ce's inspection of the <br />affecxed area. <br />106 (2) Notice of approval Of reclamation responsibility release shall <br />be published m the monthly agenda of the Board. <br />4.18 GIIVF.RAL PROVISIONS - APPEAIS TO DECISION - R~ FAQ: OF <br />FINANCIAL WARRANTY <br />(1) Anyperson aggrieved by a Office decision to approve or <br />deny the request for reclamation responsibility release may appeal the <br />decision to the Board by submitting a request for Administrative Appeal to <br />the Office within fifteen (1~ days of the date of the decision. The request <br />for Administrative Appeal mast specify the application number assigned by <br />the Office and include a statement of the factual and legal issues preseaoed <br />by the appeal <br />(2) The Office shall not reh;ase the bond until the time in which <br />to ~~ an dmin;crratiye Appeal pursuant to Paragraph (1) above has <br />expired.
