OF PIItFORMANCE AMID FINANCIAL WARRANTIES <br />4.16.1 Genera! Provisions (see Figure 4) <br />rrot3), rrr(a> (1) The Operator of any mining operation possessing a Limited <br />1r7(~ Impact Permit, a Special Permit, or a Regular Permit may file a <br />Reclamation Report sad request for reclamation responsibility mlease with <br />the O&ce whenever an Operator believes any or aIl mquirements of the Act <br />have bees completed with respect to any or all of the Affected Lands. <br />(2) The Operator shall: <br />(a) send a copy of the request to the county and to the <br />Owner of the affected land by Cert6Led Mail; and <br />(b) provide the Office with proof of such mailing prior <br />to bond release. <br />(3) The Reclamation Report and release request shall be sent by <br />Certified Mail and be separate from other types of communication to the <br />Ollice. <br />(4) Such report shall: <br />(a) contain a signed statement by the Operator or their <br />agent that all applicable portions of the Reclamation Plan <br />requirements have been satisfied in accordance with these Rules and <br />all applicable requirements under the Act; <br />(b) include a brief narrative with approximate dates of <br />completion descn'bing site grading, topsail replacement, successful <br />revegetation and other stabilaation activities, as appropriate; and <br />(c) contain sortable photographs of the reclaimed area. <br />lr7(~(a) (~ The Office shall, within SIXty (6(l) days after receiving Said <br />notice, or as soon thereafter as weather conditions penait, inspecx the lands <br />and reclamation described in the notice to determine if the Operator has <br />complied with all applicable requirements. <br />rn(s)(a) (~ ff the Oliice Fails to conduct an inspection within the time <br />specified, or fails to advise the Operator of deficiencies within the time <br />specified, then all Financial Warranties applicable to reclamation described <br />in the notice shall be deemed released as a matter of law. <br />4.16.2 Specific Provisions -Limited Impact 110 and Special 111 <br />Operations <br />The Operator/Permittee will be notified of the Olce decision within thirty <br />(30) days. <br />t gat <br />THE CODE OF COLORADO REGULATIONS 2 CCR 407-4 <br />
