III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />West Mine <br />The backfilled and graded West Mine appeared to be stable. There were no slope instability problems, nor were <br />there erosional problems. There was a moderate vegetative cover on the slopes. The fan site could use some silt <br />fence repair, however. The gate to the fan site was open and there was evidence that cows had entered the site. <br />There was a small amount of standing water in the lower sediment pond and none in the upper pond. <br />The mine ID sign was up along the road at the entrance to the partially reclaimed West Mine area and at the <br />reclaimed fan site. Surface disturbance markers were also up around the site. <br />Run-Of Mine (ROM) Stockpile <br />There was a small amount of water in the sediment pond. The gated primary was in the closed position. The <br />pond embankment was well vegetated and stable. The collection ditches and culverts were operational. There <br />was no standing water on top of the ROM pile. Surface disturbance markers and the mine ID sign were up. The <br />haul road was in very good condition. <br />Well Field <br />The road to the site was wet but passable. The mine ID sign was up at the entrance and the surface disturbance <br />markers were up around the disturbed area. The sign was up on the topsoil pile, which had a good vegetative <br />cover. <br />Hiehwav Coal Stocknile <br />This site has had the coal removed and the area covered in dirt and vegetated to keep down dust. The slopes on <br />the site were stable. The water level in the sediment pond was about five feet below the top of the pond. The <br />west side straw bales were around the railroad culvert inlet, as designed. Surface disturbance markers and the <br />mine ID sign were up. <br />Records <br />The mine records were in compliance.
