.. <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tom Kaldenbach of the Colorado Division of Minerals and <br />Geology. No one else was present during the inspection. The site was dry. Two TerraMatrix <br />employees, Scott Cowman and Jim Bethune, were repairing the fence near well HG-2 in order to <br />prevent cattle from entering the site. Both entrance gates on County Road 53 were locked. <br />East Side of County Road 53 <br />HYDROLOGIC BALANCE <br />Ditches <br />The contour ditches south of spoil spring RSP-1 are dry and in good condition. All of them are well- <br />vegetated. The collection ditch on the southwest corner of the excess spoils pile is carrying an <br />estimated 1 gpm from seep RSP-3. <br />The shoulder of County Road 53 has been graded so that most runoff from the road will bypass the <br />entrance to the mine, but more grading may be needed before long. <br />Sedimentation Pond <br />Pond HG-8 is discharging an estimated 20 gpm of clear water. The pond's inslopes and <br />embankments are well-vegetated and stable, and are not Bullied. <br />Seeps and Springs <br />RSP 3 is flowing an estimated 1 gpm of clear water. RSP 4 is wet but flow was not evident. An area <br />at the base of RSP-4 of approximately 50 square feet is covered with a white precipitate. RSP 1, 5, <br />and 6 are dry. <br />REVEGETATION <br />Small patches of thistle and bare ground were found between the slump and the location where <br />settling may have occurred along the highwall (both locations are described below). <br />SLIDES AND DAMAGE <br />Slump in Southeastern Portion of Reclaimed Pit Area <br />The markers (steel posts) on the slump appear misaligned as in last month's inspection. <br />Terramatrix plans to conduct investigatory work on the slump next week (trenching, installing <br />piezometers, etc.). Several traverses across the hillside around the slump block found no evidence of <br />mass movement outside the slump block. The outlet of the french drain was dry and has gravel in it. <br />The gravel appears to be backfill material that has washed down through the drain from above the <br />slump. The gravel is 1-inch rounded pebbles and angular pea gravel, all composed of granite. <br />Possible settling of less than 1 foot has occurred along the old highwall near coordinates N375,000; <br />E1,498,000. Settling is indicated by an apparent scarp and a 10-foot long crack in the soil. <br />-3- <br />
