III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />dunng the inspection. Comments also describe any enforcement actions taken dunng the inspection <br />and the facts or evidence supporting the enforcement action <br />This was afollow-up inspection to the April 6. 2004 Phase I bond release inspection <br />conducted by Kent Gorham of the Colorado Division of Minerals and Geology (DMG). <br />Lorencito Coal Company (LCC) submitted an application for Phase I bond release in August <br />2003 following the completion of backfilling and grading at the site. The initial inspection <br />occurred on April 6, 2004 after the application was found complete on March 10, 2004. The <br />purpose of this inspection was to verify that work cited as incomplete in April had been <br />completed by LCC. Ground conditions were dry and the weather was warm. Access was <br />excellent to all areas. <br />The following parties were present for the inspection; Mike Powell, landowner representative; <br />Ron Thompson and Bobby Steele representing Lorencito Coal Company; and Vince Vigil <br />representing Las Animas County (LAC). The inspection began with Mr. Thompson and me <br />meeting at the coal loadout. The other parties arrived shortly after the inspection began on <br />the east side of the disturbed area. to the following narrative below, each issue identified in <br />the April inspection is re-stated in italics followed by observations from this inspection. <br />East end of disturbed area -ditches <br />April comment "Ditch maintenance to remove siltation and final completion of the riprap <br />channel (placement and addition of small rock) are necessary in this area.
