Everist has approval to dispose of inert material in the pits/ponds from <br />Summit County and the Division. However, the notice sent to the Division on May 20, 1999 is <br />vague regarding the source of the material, the County sign-off procedure, the change in the <br />volume of material and the contents of the inert material. In addition, the notice does not <br />state that concrete material will be placed in the pit (either as a slurry or hard). The <br />operator should be reminded that concrete is considered inert material that has been in a <br />hardened state for at least sixty days. <br />In order to clarify the notice with the Division regarding backfilling using inert material, <br />the following information must be submitted by November 6, 2000; <br />• Specify the nature of the inert material. <br />• Explain the Summit County's role regarding the signed affidavit certifying that the <br />material is clean and inert. <br />• Clarify how the operator verifies on site that material is clean and inert, and that wood <br />and wood products are not backfilled into the pit/pond. <br />• L.G. Everist will need to ensure that any concrete disposed in the pit/pond must be in a <br />hardened state for at least sixty days. Please describe the handling and dumping <br />procedures to ensure this requirement is met. <br />• Please verify to the Division that the groundwater has not been impacted or polluted as <br />a result of the material placed in the pit/pond on August 22, 2000.
