The problems should be corrected by the dates given, or they will become possible violations. The possible <br />violations should be corrected by the dates given to reduce their severity when considered by the Mined Land Reclamation <br />Board. The inspector noted on the previous page should be notified of all corrective actions taken. <br />PROBLEMS/POSSIBLE VIOLATIONS <br />AND <br />CORRECTIVE ACTIONS <br />CORRECTION <br />DATE <br />2. <br />3. <br />4. <br />The processing and stockpile area affected area boundary is not adequately marked 8-31-2000 <br />and identifiable. PB or PV: PB <br />TOPICISI: SM <br />CORRECTIVE ACTION: <br />Install boundary markers as required by Rule 3.1.12. Submit photographic evidence of <br />compliance with this corrective action, to the Division, by the correction date. <br />Excavation at the site is not being conducted in a manner that is conducive to the <br />approved reclamation plan. <br />CORRECTIVE ACTION: <br />Submit a revision to the permit that addresses the changes in operational and <br />reclamation plans that are now required, due to the changes in mining operations <br />taking place that have resulted in a deep pit below the approved pit floor elevation, <br />and highwalls on the north side of the pit that must now be reduced by backfilling. <br />Receive approval of the revision within applicable statutory timeframes. <br />The current financial warranty for this site is not adequate to reclaim the disturbance <br />to the specifications of the approved reclamation plan. <br />8-31-2000 <br />PB or PV: PB <br />TOPICIS): MP <br />BG, RS,_ <br />Future <br />PB or PV: PB <br />TOPICISI: FN <br />CORRECTIVE ACTION: _, _, _ <br />The Division will, in the near future, forward a recalculated reclamation cost estimate <br />for the current site condition. Nielsons, Inc. will have sixty days from the date of <br />receipt of that recalculation, to submit adequate financial warranty or lower the <br />reclamation liability so the current financial warranty is adequate to cover remaining <br />reclamation. <br />Topsoil does not appear to be stockpiled separately from overburden. <br />CORRECTIVE ACTION: <br />Ensure topsoil is separated from overburden and is stockpiled separately. Submit a <br />technical revision application addressing changes to the permit maps that illustrate <br />where topsoil is stockpiled.
