III. COMMENTS • COMPLIANCE <br />Below are comments on the inspection, The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology. This coal operation has ceased coal removal and is actively <br />reclaiming the disturbed area. The weather was warm and windy and ground conditions <br />were very dry. Bobby Steele of Lorencito Coal Company and Mike Powell of the Hill Ranch <br />were present during a portion of the inspection <br />Availability of Records <br />The public copy of the mine records is kept at the office of Peak Protect Management (PPM) <br />The contact, address. and phone number for PPM is Ron Thompson, Peak Project <br />Management, 34115 County Road 20.8, Trinidad. CO 81082, 719-846-4975. All records <br />were found in compliance as detailed on page 2a of this report. <br />Roads <br />The fifth culvert mentioned in last month's inspection has been installed above Fill 8 under <br />the permanent road. Both the inlet and outlet have been armored with rock. <br />The operator has also installed culvert LWA, previously permitted immediately north of the <br />Jeff Canyon channel along the Lorencito Canyon road. This section of road was originally <br />permitted as a haul road but is now an access road, terminating at the former office area, for <br />the purposes of the coal operator (The road continues up the canyon for ranch purposes). <br />A channel has been created to route flows from culvert MKB on the Jeff Canyon haul road <br />(JCHR) to this new culvert. Rock riprap extends from the new culvert outlet to the bottom of <br />the Jeff Canyon creek. This culvert should help eliminate and minimize drainage at the <br />JCHR and LCHR intersection. <br />Hvdrolooic Balance <br />All sediment ponds were inspected. Pond 5 and pond 10 both held water to about Y: of <br />capacity. Some erosion and sloughage has occurred on the inside of pond 7 embankment. <br />likely due to wave erosion when the pond held a small amount of water. The operator should <br />monitor this condition during quarterly inspections to ensure that the embankment remains <br />stable. All other ponds at the site were dry and appeared in good condition in the event of <br />storm runoff. Ditches on the south side of the disturbed area are showing some signs of <br />siltation in various places, especially between Fill 9 and Fill 7. These ditches should be <br />cleaned when the appropriate equipment is available. <br />The downdrains of Fill 8 are nearly complete but still regwre additional small rock near the <br />bottom and the east drainage opened from ditch D98. <br />
