Compliance with Colorado Surface Coal Mining Reclamation Act <br />CRS 1973, as amended 34-33-101, et, sue., <br />and the <br />Rules and Regulations Issued Pursuant to the AcC <br />This includes a listing of the particular provisions of the regulatory program which were <br />examined during the course of this inspection, and identifies enforcement actions taken <br />during the inspection for failure to comply with Che Rules and Regulations, the Act and <br />the permit. <br />4.02.2 Mine and Permit I.D. Signs <br />The signs are in place and in good repair. <br />4.02.3 Perimeter Markers <br />The perimeter of the permit area is fenced with a 4-strand barbed wire <br />fence. The fence is in good repair. <br />4.03 Roads <br />All roads are in good condition, including the haul road across the B.L.M. <br />land. All road culverts are in place and are clear. <br />4.05.3 Diversions and Conveyance of Overland Flow <br />Material to be used to build up the embankment at the NW corner of ditch D <br />is causing ponding behind the material which is in the ditch. The ditch <br />from pond A to Mann Draw needs to be deepened at the light use road crossing. <br />4.0505 Sedimentation Ponds <br />All approved sedimentation ponds are in place. Some regrading of the <br />embankments is occuring to cut down on the slope. Pond B requires <br />cutting down the slope immediately behind the dewatering device. <br />4.05.7 Discharge Structures <br />Riprap should be placed below all pond primary spillways. <br />4.05.13 Surface and Ground Water Monitoring <br />The embankment created for the installation of Parshall flume is too large. <br />The embankment must be trimmed and regraded. <br />4.06 Topsoil <br />All topsoil is stockpiled in approved locations, and seeded (where stockpile <br />is not active). The protective buffer zone is in place around the dump <br />though some material has spilled into the buffer zone. <br />4.14 Backfilling and Grading <br />The operator has stockpiled weathered coal on one side of the horseshoe <br />dump with the intention of selling it when a market becomes available. <br />4.28 Support Facilities Not Located at the Minesite <br />No work has been under taken at the Northgate loadout facility. <br />No enforcement actions were taken at this time. <br />
