III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Janet Binns of CDMG. The Mine site has been <br />reclaimed. The permit and reclamation bond have been revoked. Reduction in inspection <br />frequency guideline was followed in order for the Division to propose a reduced inspection <br />frequency. The Trinidad area has been experiencing a drought. Mine site is very dry. No mine <br />personnel remain on site nor were any landowners encountered during the inspection. <br />Records: Records are located in the Las Animas County Clerk and Recorders Office in Trinidad, <br />Colorado. Due to the revoked nature of the permit incomplete records exist at the courthouse. <br />Complete records are available at the CDMG offices at 1313 Sherman St. Room 215, Denver, <br />CO 80203. Records available at the courthouse include: <br />1991 Bond Release Application <br />1993 CDMG Findings of permit revocation <br />1995 CDMG Reclamation bid document and amendment <br />1993 Request for Permit Revocation <br />Map V-5 of the Loadout <br />Technical Revision for Post-mining Land-use Change <br />Technical Revision for Retention of Ponds <br />Hvdrolooic Balance: <br />Mine site is very dry. <br />Pond 15P-12 is dry. The primary spillway is composed of PVC and is split and broken on the <br />inlet. The outlet of the primary spillway is open. The embankment does not show signs of <br />cracking, slumping or other instabilities. The emergency spillway was rip-rapped in July 1995 <br />by contractors procured by DMG. No water has discharged through the emergency spillway <br />since this work was performed. Gullies are present on the north side slope of the pond <br />(hillslope). These gullies are approx. 1-2 ft. deep and approx. 8 ft. long. These gullies do not <br />appear to be active and are contained within the pond. <br />Pond 15-1 1 is dry. Primary spillway appears functional. Emergency spillway received rip-rap <br />material during the 1995 DMG reclamation project. The outslope of the pond is rather steep and <br />bare of vegetation; rabbi*brush and field bindweed are the dominant species observed on the <br />pond outslope. <br />Pond P15-1 is the only pond to hold a significant amount of water. The water level in the pond <br />was approximately 3 ft. below the primary spillway and very muddy. Cattle were utilizing pond <br />15P-1 during the inspection. No rills or gullies were noted at this pond. The Primary spillway <br />appeared in functional condition. The emergency spillway did not show any indication of <br />problems. The seep previously observed at the toe of the embankment adjacent to the primary <br />spillway discharge was dry. The road ditch at the P15-1 outfall location has downcut roughly 3 <br />ft. This downcut is not cutting into the embankment. <br />These three ponds appear in good condition based upon criteria outlined in the RIFT checklist. <br />Pond 15P-20 contains muddy water approx. 3 ft. below primary spillway. Cattle have been on <br />pond 15P-20. Primary and Emergency spillways appear functional. Emergency spillway was ~ip- <br />rapped in 1995. An old gully is present at the western inlet of the pond. Rocks have been <br />placed in this inlet to slow the gully formation. Gully does not appear to be active. the slope <br />
