III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This permit is in temporary cessation. <br />Availability of Records <br />Records were checked at the offices ofHydro-Environmental Solutions, Inc. See the DMG Availability of <br />Records Check Sheet at the end of this report. All required records were on file. <br />Signs and Markers <br />New Topsoil Mazkers had been erected. Mine identification signs and permit boundary markers are up <br />and in good repair. Information on the mine permit identification signs was complete and accurate. <br />Roads <br />There was no noticeable change since the previous inspection. The road into the office trailers has been <br />rehabilitated. No (approved) new road work had been accomplished. <br />Hydrologic Balance <br />There was no discharge from Ponds 1 and 2, and no surface runoff noted on site. The embankments of <br />both ponds appeared to be in good repair. Maintenance is due on culverts LFC-2, LFC-3, LFC-4. LFC- <br />l land RRC-18. <br />Backfill and Gradine <br />There has been no noticeable change since the previous inspection. With the exception of backfilling <br />and grading associated with the laying of underground water lines, no part of the required (eventual) <br />backfilling and grading of disturbed areas has been accomplished (there has been no demolition of <br />structures or reclamation). <br />Stu Wort Facilities <br />Both the office building and new annex (trailer) to it are occupied. As previously reported, other <br />structures, other than the sedimentation ponds and ditches, are in disrepair. Some of these structures <br />have been vandalized. Temporary repairs had been made. As previously reported, the rail spur switch <br />at the main line has been dismantled. No permitted construction on the conversion of the site to a coal <br />load-in facility has been initiated. <br />Topsoil <br />There has been no noticeable change since the previous inspection.
