• (Page 2) • <br /> <br />MINE ID # OR PROSPECTING ID # M-94-027 <br />INSPECTION DATE 4/26/2001 <br />INSPECTOR'S INITIALS TAS <br />1. A follow-up site inspection was conducted of the Distel Farm Resources operation from the <br />Division's previous inspection on 4/26/01. The purpose of the current inspection was to <br />evaluate tha status of mining and reclamation throughout the permit area, determine if the <br />operator is in compliance with the terms of the mine and reclamation plan, and whether the <br />existing financial warranty is adequate to cover the existing and/or planned liability. <br />Present during the inspection was Connie Nickel Davis, Damian Murphy, and Blair Cooley of <br />Aggregate Industries. <br />2. The Distel Farm Resource contains a total of 530.3 permitted acres. Of this 530.3 acres <br />there appears to be a maximum allowable disturbance at any one time of 393.3 acres. The <br />operator ha.s posted a financial warranty of $1,483,800 in the form of a corporate surety <br />bond. On average, this would allow for approximately $3,773/acre to be spent on <br />reclamation. <br />3. The Distel Farm Resource permit area contains 6 distinct properties or areas. These <br />include the Peschel Property, Sherwood Property, Bigelow Property, Distel Property, <br />Longmont Property, and Plant Site area. <br />4. The Peschel. Property is currently undisturbed. The operator reports that they may start <br />mining in the Peschel Property 3-4 months prior to the end of 2002. The Peschel Property <br />contains aii unlined pond from historic or pre-law mining disturbance, ie: prior to 1977. <br />5. The operator completed mining in the Sherwood Property in 1999. The Sherwood Property <br />contains several ponds that have only been partially reclaimed. The operator's current <br />plans for this property are to begin dewatering in October, 2001 and then when conditions <br />allow, bac}:fill certain areas where a bike trail will be installed, and regrade shoreline <br />slopes to final reclamation contours as specified in the reclamation plan. There will <br />also be a need to respread topsoil and revegetate shoreline and surrounding disturbed <br />areas that are above the anticipated high water line. <br />6. The Bigelow Property is divided into two (2) parts via the St. Vrain River. The Bigelow <br />Property north of the river is currently undisturbed and never will be disturbed by <br />mining. T:~e Bigelow Property south of the river is currently disturbed. Dry mining in <br />this parcel is nearly complete, with a few months of excavation to be completed in the <br />northest c~~rner. The operator reports that final reclamation of this disturbed property <br />will begin in 2002. <br />7. Excavation has been completed in a majority of the Distel Property. Topsoil and <br />overburden stripping operations are occuring in the recent expansion area in the north end <br />of the property. The operator estimates that there are 3 months of mining excavation to <br />be comp let=d. The Distel Property contains topsoil and overburden stockpiles as well as <br />a large settling pond for the entire operation this is still being used. The settling <br />pond will be reclaimed to a wetland. The operator reports that mining should be completed <br />within the Distel Property in early 2002, and reclamation measures will be employed where <br />feasible. <br />8. The Longmwit Property has not been disturbed yet. The operator reports that this property <br />will be the last area to be excavated which will occur after mining is completed in the <br />Peschel Property. <br />9. The Plant Site area is currently disturbed and will likely be the very last portion of <br />affected ].and to be reclaimed at the Distel Farm Resource. Review of permit file <br />indicates that there are no specific plans for reclamation of the plant site (included in <br />
