Comments - Compliance <br />Below are particular issues with regard to any of the compliance items. <br />Enforcement actions resulting from failure to comply with the Act, Rules <br />and Regulations, and the permit also are identified below. <br />4.03 - Roads <br />Road surfaces were generally wet and muddy due to recent <br />precipitation and freeze-thaw cycles. Ditches and culverts will need to <br />be maintained soon to accommodate spring runoff and precipitation. In <br />particular, the clear water culvert east of the main intake portal was <br />partially blocked and in need of cleaning. <br />4.05 - Hydrologic Balance <br />Mine water was being discharyed from the main intake portal <br />into the drainage system leading to the sediment pond. <br />4.28 - Support Facilities Not Located at the Mine Site <br />The loadout in Delta was inspected during this visit. <br />Equipment has been hauled from the site to the Terror Creek loadout near <br />Paonia. Grand Mesa Coal Company intends to remove all of the remaining <br />stockpiled coal within the near future. <br />The binding agent and snow fence appear to be effective in <br />controlling fugitive dust generation from the stockpile. <br />
