._
III. Comments - Compliance
Below are particular issues with regard to any of the compliance items.
Enforcement actions resulting from failure to comply with the Act, Rules
and Regulations, and the permit also are identified below.
4.03 - Roads
Road surfaces were generally wet and muddy due to recent
precipitation and freeze-thaw cycles. Ditches and culverts will need to
be maintained soon to accommodate spring runoff and precipitation. In
particular, the clear water culvert east of the main intake portal was
partially blocked and in need of cleaning.
4.05 - Hydrologic Balance
Mine water was being discharyed from the main intake portal
into the drainage system leading to the sediment pond.
4.28 - Support Facilities Not Located at the Mine Site
The loadout in Delta was inspected during this visit.
Equipment has been hauled from the site to the Terror Creek loadout near
Paonia. Grand Mesa Coal Company intends to remove all of the remaining
stockpiled coal within the near future.
The binding agent and snow fence appear to be effective in
controlling fugitive dust generation from the stockpile.
