The MLRB ordered: "Provide a modification to Permit M-94-117 within 30 days of <br />the Board hearing that includes a plan to provide adequate process water storage <br />capacity at the Gold Hill Mill. Such plan must be approved by DMG no later than 60 <br />days from the date of submittal". <br />2. Franklin/Walsh are of the opinion that this order has already been satisfied by our <br />October 15, 1997 submittal of the Conceptual Reclamation Plan for this site. In other <br />words, the reclamation plan proposes that the tailings pond be closed, that the Hazel A <br />adit be returned to the owner, that the mill be decontaminated, and that any process <br />water from these sources be evaporated. This reclamation plan therefore negates the <br />need for a process water storage capacity plan. <br />3. Franklin/Walsh are also of the opinion that even if the reclamation plan is not <br />implemented, there already is adequate process water storage capacity at the site, and <br />that a plan is therefore not required. As shown in the attached spreadsheet, <br />calculations by the DMG on February 27, 1996 show that there is 0.22 acre-feet of <br />excess process water storage capacity at the site, even after a 100 year-24 hour <br />stormwater event.
