GOLD HILL MII,L, BOULDER COUNTY, COLORADO FII,ENO.: M-94-117 RESPONSE TO CORRECTIVE ACTION ORDER PROCESS WATER STORAGE CAPACITY MLRB MEETING OF SEPTEMBER 24, 1997 Dear Gary: This letter and the attached spreadsheet constitute the response to the DMG prepared by Walsh on behalf of Franklin Consolidated Mining Company, Inc. on the referenced subject. 1. The MLRB ordered: "Provide a modification to Permit M-94-117 within 30 days of the Board hearing that includes a plan to provide adequate process water storage capacity at the Gold Hill Mill. Such plan must be approved by DMG no later than 60 days from the date of submittal". 2. Franklin/Walsh are of the opinion that this order has already been satisfied by our October 15, 1997 submittal of the Conceptual Reclamation Plan for this site. In other words, the reclamation plan proposes that the tailings pond be closed, that the Hazel A adit be returned to the owner, that the mill be decontaminated, and that any process water from these sources be evaporated. This reclamation plan therefore negates the need for a process water storage capacity plan. 3. Franklin/Walsh are also of the opinion that even if the reclamation plan is not implemented, there already is adequate process water storage capacity at the site, and that a plan is therefore not required. As shown in the attached spreadsheet, calculations by the DMG on February 27, 1996 show that there is 0.22 acre-feet of excess process water storage capacity at the site, even after a 100 year-24 hour stormwater event.
