III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of Minerals <br />and Geology (Division). This processing and loadout site has been inactive since June 2001 <br />after the closure of the Lorencito Mine (#C-96-084). Various reclamation and maintenance <br />are ongoing at this site. Ground conditions were very dry and the weather was unseasonably <br />warm. <br />Hvdrolooic Balance <br />The operator has now removed approximately six acre-feet of sediment from pond 8. The <br />material is now being stockpiled on a coal stockpile area as potential product for future <br />The operator must demonstrate that the pond volume established after clean out is sufficient <br />to hold both the estimated storm runoff volume above the 100% sediment level to ensure <br />adequate water treatment. This may require the removal of significantly more sediment to <br />establish a total volume below the top of the primary riser of 10 24 acre-ft. The operator has <br />not completed the required repairs to the west side conveyor ditch at the intersection with the <br />east downdrain. The gullies above the conveyor culvert have also not been repaired as of <br />yet. <br />
