Cottony <br /> Division Director <br /> Natural Resource Trustee <br />RE: Inspection Reports Response and Powderwash #19 Infoitnation <br />Deaz Marvin, <br />The Division of Reclamation, Mining and Safety received the two information packages you sent. I will <br />respond to~~the items Crom your Inspection Reports response as they are numbered: <br />1. VTUttIe Pit (M-1992-007) -The Division concurs that the map illustrating the placement of the trees <br />(provided in the original permit application), and the landowner's opportunity to comment on this <br />application are sufficient to allow the trees to remain in place without a letter of concurrence from the <br />landowner. <br />2. Powderwash #66 (M-2005-006) -The Division defers to the approved mining and reclamation plans <br />submitted by Moffat County. The main concern with regard to the proposed culvert is that its <br />placement falls within the constraints and regulations of the Office of the State Engineer and the Army <br />Corps of Engineers. Since Moffat County has committed to complying with the Army Corps of <br />Engineers' 404 Permit Rules, this meets the requirements of the Division's Rules and Regulations. <br />Please note that the culvert will need to be removed prior to final release of the site. <br />3. Thank you for this clarification and correction. <br />4. Based on your description of the secondary containment for this fuel tank, the Division feels that this <br />storage facility is in compliance with the Division's Rules and Regulations. <br />5. Information the Office of the State Engineer provided to the Division concerning the "72-hour Rule" <br />is enclosed. Please contact the Division of Water Resources/Office of the State Engineer for additional <br />infomlation and/or clarification at (303) 866-3581. <br />Thank you for providing additional information regazding the Powderwash #19 Pit (M-1978-008) for our <br />records.
