III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology (DMG). The weather was cool, clear. and very windy Ground <br />conditions were variable, ranging from patchy snow/mud to dry areas. Access was <br />reasonable, except to pond 5 in the bottom of Cow Canyon. Only monitoring and minor <br />maintenance has occurred at this site since the last inspection. <br />Availability of Records <br />The public copy of the mine records is kept at the office of Peak Protect Management (PPM. <br />The contact, address, and phone number for PPM is Ron Thompson, Peak Project <br />Management, 34115 County Road 20.8, Trinidad, CO 81082, 719-846-4975. All records <br />were found in compliance as detailed on page 2a of this report. <br />Hydrologic Balance <br />As mentioned in previous reports, pond 9 appears full of sediment from the large storm <br />runoN that occurred in August of this year. Sediment seems to be drying as indicated from <br />surface desiccation cracks but observation of material 12 inches below the surface indicates <br />significant moisture remains in the deposited sediment. It may be beneficial to attempt to dig <br />out a corner of the pond to serve as a drain for the underlying sediment and moisture. <br />The weir at pond 7A outlet has <br />been leveled. The embankment <br />at this pond should be checked <br />for adequate freeboard as soon <br />as possible. Pond 7A held a <br />frozen body of water well below <br />the lowest riser hole. Ponds 5, <br />6A, 8, 9A, and 10 also held <br />frozen bodies of water due to <br />recent cold temperatures. All <br />ponds appeared stable and in <br />good condition. <br />Ditches and culverts site wide <br />were observed and appeared ~~: <br />good condition One exception <br />is the lower ditch on the <br />northwest side Of the disturbed d'8d JC'.
