III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of Colorado <br />DMG. Dave Berry also represented the Division. No one was present <br />to represent the operator. The operator's consultant is preparing <br />to hire a contractor to do additional work at the mine site, <br />including substituting a new ditch-lining material in place of the <br />geoweb at the office SAE. Also included in this report are the <br />results of a topsoil depth survey of the yard area. Fifteen holes <br />were dug. <br />SIGNS AND MARRERB <br />Both mine ID signs were up and contained the correct information. <br />Surface disturbance markers need to be replaced since they are <br />fading. The surface disturbance markers at the portal area, <br />however, were quite visible. Stream buffer zone signs were up <br />between the yard area and Trout Creek, but several of the signs <br />need to be raised higher on their support posts. <br />BEDIMENT POND <br />There was no water in the sediment pond. Both spillways were <br />functional. Pond inslopes and outslopes were erosionally stable. <br />The embankment appeared to be stable. <br />DITCHEB. CIILVERTB AND BERMS <br />Ditch D-1 needs a little cleaning just above culvert C-1. For now, <br />the ditch is still functional. Ditches D-2, D-4, D-6 and D-8 all <br />had sufficient capacity, although D-8 could use some touching up <br />just above the road Swale. The upper portion of the road Swale <br />could use a little cleanup as well. The office SAE geoweb ditch <br />needs repair. The operator is planning on replacing the ditch <br />lining with a new type of lining. <br />The outlet of culvert C-1 needs a little cleaning. The inlet of <br />culvert C-4 also needs a little cleaning. Both culverts are still <br />functional, however. <br />The yard berm is functional. <br />1 <br />
