III. COMMENTS • COMPLIANCE <br />Deserado C-1981-018 <br />20 September 2007 G~j <br />Page 1/4 <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Deserado Mine conducted on 20 September <br />2007 by Jim Stark of CDRMS. Scott Wanstedt of BME was off that day so Bob Lee of <br />BME accompanied me on the inspection. The Deserado Mine has received a pretty <br />good amount of rain over the past few weeks. The weather was warm and sunny <br />and the ground was dry. <br />The mine has elevated CO levels due to a suspected fire in the gob and has had to <br />seal off the current longwall panel and the longwall itself. Jeff Dubert stated that it <br />could be from 30-90 days before they would be able to get back in to that panel. <br />He did state that the mine was still able to do development mining with the <br />continuous miner. They were actively drilling a borehole at the site of the panel, near <br />the Halandras landfill, under the direction of MSHA. BME was reminded that any <br />efforts to fight the fire from the surface must still be done in accordance with the <br />Rules and standards set forth under SMCRA. <br />Signs and Markers: All of the necessary signs (including the mine ID signs, permit <br />boundary signs, refuse pile ID signs, subsoil stockpile signs and topsoil stockpile signs) <br />were properly displayed and in good condition. <br />Roads: The access road to the mine site is a paved road. The road was well <br />maintained and in good condition. <br />-The haul road to the refuse piles (RP-1, RP-2/3/4 and RP-Sa) was well maintained <br />and in good condition. The road appeared stable and there were no signs of <br />erosional problems on the road. <br />-The conveyor corridor road was well maintained and stable. There were no <br />erosional problems noted with the road. <br />-The road spur to the rock dust tank RDH-2 was well maintained and appeared to be <br />stable at the time of the inspection. No erosional problems were noted on the road. <br />-The light-use road to the water tank bench was well maintained and appeared to <br />be stable at the time of the inspection. No erosional problems were noted on the <br />road. <br />Hydrologic Balance: -Pond RP-1 was dry at the time of the inspection. The pond <br />embankment was well vegetated and appeared to be stable and there were no <br />erosional problems on the embankment at the time of the inspection. <br />- Pond RP-2/3 was dry at the time of the inspection. Only the west cell of the pond <br />contained a small amount of water at the time of the inspection. There was some <br />sediment in the pond but it does not appear to be a problem at this time. The pond <br />embankment was well vegetated and appeared to be stable. There were no <br />erosional problems noted on the pond embankment. <br />
