III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Tom Kaldenbach of the Colorado Division of Minerals <br />and Geology. No one else was present. Greg Lewicki, the operator's consultant, was contacted but <br />was unable to be present during the inspection. The site was covered with 6 inches of snow. <br />AVAILABILITY OF RECORDS <br />As shown in the attached checklist, the following documents could not be found in the operator's file <br />that is kept at the Routt County Clerk and Recorder's office. All of these documents should be <br />inserted in the file. <br />An insurance certificate that contains: a) the wording "will endeavor to" struck, b) the <br />insured's current address, and c) an indication of the type of insurance. <br />2. 3 years of DMG/OSM inspection reports and enforcement actions, <br />3. Midterm Review documents, <br />4. The most recent NPDES Permit, <br />5. Two NPDES Discharge Monitoring Reports (for 7/1/97-8/31/97 and 9/1/97-10/31/97). <br />SIGNS AND MARKERS <br />The two mine i.d. signs on County Rd. 29 have been updated to show the operator's current address <br />and phone number and the DMG's name, address, and phone number. Other signs required on the <br />site were up and contained the correct information. <br />HYDROLOGIC BALANCE <br />Sedimentation Pond <br />The pond was covered with snow and contained no water. The two discharge structures appeared <br />functional. The pond's inslopes, outslopes, and embankment were well-vegetated and stable, and <br />were not Bullied. <br />Ditches and Culverts <br />With the exception of part of ditch D8 ,all ditches and the Swale in the road meet design capacity and <br />have positive drainage. The part of D8 that does not have positive drainage is a low area <br />approximately 150 feet downgradient from culvert C4. Overall, D8 appears to be functioning properly. <br />Culverts C1 and C4 are clear and are functioning. <br />Alluvial Monitoring Wells <br />The new downgradient well on the Baumgartel's land had a cap on it and appeared to be in good <br />condition. The new upgradient monitoring well could not be found in the snow and may not have been <br />installed yet. <br />Page 3 <br />
