Comments also,describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />A complete quarterly inspection o1 the Roadside Portals Mine was conducted by Dan Mathews <br />of the DMG Grand .lunction Office. The inspection was conducted on the afternoon of <br />December 18. beginning at 1:30 p.m., and continued on December 22, beginning at 9:00 a.m. In <br />addition. Pond 12 was inspected on the afternoon of December 5, 1997, to check abatement of <br />NOV C-97-001. At the time of the NOV abatement inspection, Pond 12 had been completed and <br />certified. and contained mine+vater below the level of the primary spillway. As a result, a <br />termination notice for NOV C-97-001 was issued at that time. Larry Reschke ofPCC was <br />present during the inspection on December 18, and December 22, and Bob Blue was present <br />during the NOV abatement inspection on December 5. <br />Availability of Records <br />Required records were reviewed in the mine office, and in general were complete and up to date. <br />h was noted that the insurance certitlcate on file had an expiration date of December 31, 1997. A <br />renewed certificate will need to be placed on file and submitted to the Division. Also, it was <br />noted that the .Annual Hydrology Report (AHR) for ] 996 has not ye[ been completed. This was <br />discussed with the operatrn. The AHR due date is March 31, for the preceding water yeaz. The <br />Division has ~~ranted t++o extensions to the submittal deadline for the 1996 AHR, in part to allow <br />the operator ro focus time and efforts on a major permitting action, the recently approved PR-02. <br />Extension beyond January 31. 1998, ,gill not be granted, and failure to submit the 1996 AHR by <br />that date may result in an enforcement action. <br />Pond 12 certilicatiun starement was provided at the time of the inspection. Two minor changes <br />to the certification are requested. First, the statement erroneously references designs in Appendix <br />13-~ of the permit application. Appendix I;-5 is a refuse pile stability study; the certification <br />should be anuniied tip rrl~erence .Appendix 13-2 pond designs. Second, the plan view drawing on <br />page RSN-47 of Appendix 13-? depicts the mine discharge line entering the pond at the northeast <br />corner. The line actually enters the pond at its southeast corner, and the certification statement <br />should be amended to reflect this minor change. <br />Roads <br />Most roads were in good condition, with surfaces and ditches maintained since the high intensity <br />rainstorms which occurred in portions of the permit area in September. Maintenance of the inlet <br />to the 72" road culvert on Coal Gulch, between CRDA-1 and Pond 11, mentioned in the previous <br />complete inspection. had not yet been completed. Flood flows in Coal Gulch had deposited rock <br />and sediment. and dislodged riprap immediately above the culvert inlet. Sediment 1 [0 2 feet <br />
