III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />height no greater than five feet as measured from the invert of the spillway to the up stream toe <br />of the embankment. <br />During the safety demonstration review, it was determined that the requirements of Rule <br />4.05.9(8)(b) have not been satisfactorily demonstrated. Where failure would not be expected to <br />cause loss of life or serious property damage, any impoundment not meeting the size or other <br />criteria of 30 CFR 77.216(a) shall have a minimum static safety factor of 1.3 for a normal pool <br />with steady state seepage saturation conditions. Please provide ademonstration/stability analysis <br />for both the permanent and temporary stock ponds, which shows that all stock ponds have a <br />minimum static safety factor of 1.3 in accordance with Rule 4.05.9(8)(b). Approval of TR-35 is <br />pending submittal of this demonstration. <br />All other temporary stock ponds were inspected. Stock ponds T-6 and T-9 were proposed but <br />never built. Stock Pond T-7 has been backfilled and topsoiled, but still needs to be seeded. <br />Stock Ponds T-10, T-11, T-12, T-13, T-15, and T-25 have been reclaimed. Stock ponds to be <br />reclaimed (i.e., temporary impoundments) shall be examined at least quarterly in accordance with <br />Rule 4.05.9(17). Upon approval of TR-35, permanent stock ponds shall be inspected yeazly until <br />release of the performance bond. <br />General Mine Plan Compliance <br />With the approval of Permit Renewal No. 4 and Technical Revision No. 34, SCC committed to <br />revising the existing reclamation schedule and timeframes for completing backfill and grading, <br />topsoil redistribution, and seeding and planting at the Seneca II Mine. On October 10, 2002 the <br />DMG approved TR-34 including a revised Exhibit 13-2 showing timeframes for fmal <br />reclamation activities at the Seneca II mine. SCC has not met these permit conditions at the <br />following locations. <br />Location of former "dozer pit" and Wadge East Pit azea: approximately 24.48 acres remain to be <br />topsoiled and seeded, approximately 46.88 acres have not been seeded following topsoil <br />replacement in 2002. SCC agreed to have topsoil replacement and seeding completed by 10/02 <br />and 11/02, respectfully (see Exhibit 13-2). <br />Road FI and Wolf Creek Pit azeas: approximately 36.65 acres remain to be seeded following <br />topsoil replacement in 2002. SCC agreed and committed to having seeding completed by 11/02 <br />at these locations (see Exhibit 13-2). <br />Notice of Violation CV-2003-005 is being issued for: failure to comply with permit conditions <br />and for failure to conduct topsoil redistribution and seeding according to reclamation schedule <br />and established timeframes. <br />
