` . • (Page 2) . <br />MINE ID # OR PROSPECTING ID # M-83-176 <br />INSPECTION DATE_March 24, 1998 INSPECTOR'S INITIALS TAS <br />OBSERVATIONS <br />1. A site inspection was made of the Speer Development site, approximately 5 miles southwest <br />of Brighton, Colorado along old Brighton Road. Mr. George Speer was present during the <br />inspection. <br />2. The operation is permitted for a total of 30 acres, with a "phased" mining plan utilizing <br />wet mining methods. The 5 Phases of mining vary from 5 to 8 acres in size. At the time of <br />inspection there was only a small disturbance of approximately 1 acre in the Phase 1 area. <br />The post-mining land use for the site is wildlife habitat and recreation/private lake. The <br />operator has posted a financial warranty of $21,000 in the form of a Letter of Credit. <br />3. The 1 acre of disturbance in the Phase 1 area consists of a small lake approximately 22 <br />feet deep, according to Mr. Speer. Mr. Speer indicated that he has a well permit to account <br />for evaporative loss from the pond, which was excavated after December 31, 1980. The <br />Division will check with the Office of the State Engineer within the next 10 days to verify <br />is this information is correct. The slopes surrounding the lake are approximately 1:1 and <br />will need to be graded to a slope of 3:1. The perimeter of the lake will also need to be <br />graded to final contours. The perimeter areas will be topsoiled, seeded with a grass mix, <br />and then planted with trees and shrubs. The existing financial warranty is adequate to cover <br />the cost of reclamation in the Phase 1 area. <br />4. An entrance sign was posted and the boundaries of the 30 acre permit area were marked as <br />required by Rule 3.1.12. The disturbance in the Phase 1 area was verified to be within the <br />permit area. <br />5. The only concern noted during the inspection was that the site has been inactive since <br />1984, according to Mr. Speer. Review of the permit file verifies this. There is however, <br />no correspondance indicating that Mr. Speer has filed a notice of temporary cessation as <br />required by Rule 1.13.5. Further, the maximum allowable period of temporary cessation is 10 <br />years, ie: 2 5-year terms. it appears that the Speer Development site has already exceeded <br />to years of inactivity. This matter is considered to be a problem that will require <br />corrective measures by the operator in order to bring the site into compliance with the <br />Construction Material Rules ~ Regulations. The Division requests that the operator complete <br />one of the following actions within the next 30 days: 1) resume active mining, 2) begin <br />final reclamation of the 1 acre of existing disturbance within 30 days and complete all <br />required reclamation tasks by October 31, 1998.
