III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Man Strip Mine and Walden loadout facility conducted on <br />May 27, 2004 by Mike Boulay of the DMG. There was no representative from Kerr Coal <br />Company present during the inspection. Weather conditions were cloudy and cool. Ground <br />conditions at the mine site were dry. There was no activity at the mine site during the inspection. <br />Availability of Records <br />Records were reviewed at the Montgomery Watson Hazza office in Steamboat Springs on the <br />afternoon of May 26, 2004. With only minor exceptions, all required records were on file and <br />available for review. Please see the attached Availability of Records checklist. <br />Roads <br />The permanent light use road that accesses the site was dry and in good condition. The entire <br />mine site was accessible. The temporary light use road that accesses Pond G was dry and stable <br />with no problems noted. The first culvert located beneath the light use road to Pond G had a <br />small amount of sediment accumulated on the outlet side. All other culverts site wide were well <br />maintained and clear of sediment and debris. <br />HydroloQic Balance <br />All site sedimentation ponds were inspected. Pond A was retaining water at a level <br />approximately 2 feet below the level of the principal spillway. Pond A embankment was stable <br />and dry. The Pond A outlet pipe continues to discharge a trickle of water probably due to a <br />minor leak in the riser pipe or discharge pipe. If the leak becomes more prevalent, repair of the <br />dischazge structure may be warranted. Pond B was retaining water a few feet below the weep <br />hole in the principal spillway. A rill has formed at the southwest comer of Pond B. If further <br />erosion continues at this location, the rill should be repaired. Pond C was dry. Ponds D and E <br />were retaining water but were not discharging. Pond F was retaining a small amount of water. A <br />pair of ducks and four ducklings were utilizing Pond F at the time of the inspection. Pond G was <br />dry and the embankment was stable. A gully has formed between the two topsoil piles located <br />above Pond G. <br />Site ditches PD 1 and PD2 appeazed stable and for the most part were well vegetated. Some <br />minor erosion is appazent below the outflow point above Pond A, just below the confluence of <br />
