Cottony <br />Division Director <br />Natural Resource Trustee <br />The above-mentioned site has had one or more problems noted that, according to Division of Reclamation, Mining and <br />Safety (Division) records have not yet been resolved. According to our records, the following problem{s) was{were) to be <br />resolved on or before May 30, 2007. Listed below are descriptions and corrective actions for the problem(s). Please resolve <br />the corrective actions and provide evidence of such resolution on or before October 31, 2007. <br />Please note that if the corrective action(s) are not properly addressed, and evidence provided to the Division by the date <br />provided above, the listed problems could become escalated to the level of possible violations and would then be referred to <br />the Mined Land Reclamation Board for further action. <br />If the problem(s) has have) already been remedied, please provide evidence of its(their) completion. <br />Recycled blacktop stockpile onsite, which is not a part of the approved mining and reclamation plan. <br />CORRECTIVE ACTION: <br />Submit a notice on the use and storage of the blacktop to the Division pursuant to section 3.1.5(9) of the Mineral <br />Rules and Regulations- including the following information on or before bfay 30, 2007: <br />* Written documentation of the intended use of this asphalt. <br />* Written documentation of the wishes of the landowner to use this material for road maintenance and <br />that the material be left onsite after reclamation and final surety release. <br />* Written statement committing to not bury the asphalt or in any way use this material as backfill or <br />pond fill. <br />* A narrative and/or a map that describes/illustrates the approximate location of the asphalt stockpile. <br />* The approximate volume of the asphalt. <br />* Signature of the operator and landowner. <br />If you have any questions or concerns, please contact me at (303) 866 179. <br />Thank you for your prompt attention in this matter. <br />Sincerely, <br />~~ ;'%~_ <br />Doff Zack ' ) <br />Environmental Protection Specialist <br />Office of Office of <br />Mined Land Reclamation Denver Grand Junction Durango Active and Inactive Mines <br />
