III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />A partial inspection of the Hawks Nest Mine was completed by <br />Christine Johnston of the Division. This site is a bond forfeiture <br />site. The weather during the inspection was clear and warm. There <br />was no snow on the site. <br />Hvdroloaic Balance <br />The erosion control mat located in the east mine channel, appears <br />to be stable. Some grass is beginning to sprout in the upper reach <br />of the channel. Minor erosion was noted in the east mine area; <br />adjacent to the lined channel,on the east and west side, and on the <br />east side of the channel. The erosion on the east side of the <br />channel begins between the second and third contour furrow. The <br />rill follows the third contour furrow and then breaks through the <br />furrow and down to the berm on the south end of the site. The rill <br />follows along the berm and breaks the berm at the lined channel. <br />Some minor grading to repair the contour furrows and placement of <br />hay bales may be necessary. in the silo area, minor erosion was <br />noted towards the bottom of the slope, as it steepens slightly in <br />this area. It appears that the railroad, when regrading their <br />right-of-way and the ditch adjacent to the tracks, pushed up some <br />coaly material on the reclaimed land. I believe that the erosion <br />in this area worsens due to the presence of the coaly material. <br />Regrading in this area may be necessary. The two hay bales located <br />in the ditch adjacent to the railroad tracks, near the substation, <br />will need to be replaced. One bale is deteriorating and both bales <br />are no longer keyed into the ditch. It appears that water is going <br />around the north bale and cutting into the slope. Because the <br />railroad regraded the ditch along the tracks, coaly material has <br />been pushed into the ditch and is being carried down to the river. <br />The hay bales located at the outlet of this channel should be <br />replaced. <br />Backfillina and Gradin <br />The material which has temporarily backfilled the east portal until <br />a permanent seal can be constructed, appears to be stable. <br />Suooort Facilities <br />The barrels stored in the east mine area that are awaiting proper <br />disposal, appear to be in good condition. The tarp covering the <br />barrels appears to be in good condition as well. There is some <br />water in the bermed area. It does appear that the barrels may have <br />leaked. There is an empty barrel found at the west end of the <br />permit area, just inside the permit boundary (as noted by the <br />permit boundary sign). The barrel should be removed when the other <br />barrels are removed from the site. <br />
