were observed. Mine dewatering pumps were both off. Ponds 5-P5, P6, and P7 are drying out for planned leak <br />repair. Cell 5-P7 is the only cell that appazently is leaking due to burrows in the embankment. Piping between <br />ponds is slated for repair work as well. Cells 5-P6 and 5-P6 remain functional and can manage any mine water <br />that may need to be pumped prior to repair completion. North angle is not currently pumping. Low water level <br />in 9-P2 and 9-P3 ponds indicate that no pumping to the ponds has occurred for some time. BTU-Empire/RAG- <br />EC continues to work with CDMG-AML group for Wise Hill #4 underground fire project [Bovine Project]. <br />The SAE located south of ditch 5-Dl needs silt fence either removed or repaired. The silt fence is not an integral <br />part of the SAE demonstration so removal will not affect the performance of the SAE. <br />Backfill and Gradine: Portal No. 5 slope that was backfilled in 2004 remains in good condition. There was no <br />evidence of rilling or gullying from the recent snowmelt. Williams Fork mine area remains in good condition <br />free of gully formation or rilling. Repairs conducted at the AML Wise Hill coal seam fire subsidence location <br />remain sealed and no open holes observed. <br />Support Facilities: Portal No. 5 area is well graded. Run-off is draining to perimeter ditches. One small area <br />west of the stacker tube is pooling a small amount of water. This location is small and poses no stability <br />concerns. Non-coal waste material, wood timbers etc., have been piled in one location for removal at a later date. <br />The operator is using the Portal 5 warehouse for training purposes. Facilities area is clean and in good condition. <br />SA portal area remains neat, with mining equipment and materials neatly stored around portal bench. Runoff is <br />draining to appropriate ditches and not pooling. Portals remain sealed. <br />Processing Waste: Both waste piles remain inactive. snowmelt is draining offthe waste pile area. No. 9 Portal <br />waste pile shows no evidence of water ponding on this waste fill area. No problems were noted with either coal <br />processing waste area. <br />General Mine Plan Compliance: BTU-Empire/RAG-EC ownership transfer application remains under review <br />until outstanding adequacy concerns are resolved. RN-04 remains under review pending resolution of adequacy <br />concerns. DMG has provided the operator with adequacy concerns regarding SL-02. SL-02 remains under <br />evaluation pending acceptable responses to the Division's adequacy concerns. <br />Mine site is in good condition. Three maintenance items were identified; complete repairs to 5-P7 embankment, <br />repair burrows on 9-P2 embankment, and remove or repair silt fence at SAE south of Portal No. 5 Coal storage <br />area. <br />Fish and Wildlife: A nesting Great Horned Owl is present in the rock outcrop at the Portal No. 5 area. Due to <br />limited activity at the mine the operator minimize potential disturbance to the nesting activity. Badgers and <br />ground squirrels continue to dig in roads and occasionally on pond embankments. Operator needs to continue to <br />repair damage caused by animals. Hawks were observed at the HR-1 pond. Elk and pronghorn were actively <br />utilizing the Williams Fork Mine reclaimed area. <br />Reve¢etation: Operator is scheduling weed control activities to manage knapweed patches. Timing of weed <br />control efforts at opportune time will aid in effectiveness of weed management efforts. <br />Grasses were beginning to emerge on backfilled slope at Portal No. 5 area. <br />
